The aim of the paper is to reconstruct and present in a critical perspective the main methodological devices of John Rawls’ Political Liberalism, which introduces the idea of the overlapped consensus as a way to guarantee, in a political sense, social justice within contemporary democratic societies. Those methodological devices are presented in order to reveal their conceptual failures when contrasted with real world situations and to indicate three elements: a) the psychologism of the theory which reduces the individuals of (...) the comprehensive doctrines to an inhuman procedural forgetting of the historical facticity that defines them and provides them with meaning and identity; b) how unfair the overlapped consensus might be, considering that it is developed without taking into account the doctrines and at the expenses of the historical processes for power and struggles for recognition of such doctrines; iii) the limited reach of the methodological devices when applied to the real world, i.e., that when those devices are faced with the realities of the doctrines they lack practical justification. Because of that, liberalism should be considered as another tradition which struggles with the doctrines. (shrink)

El presente trabajo explora la postura bergsoniana en torno a la imagen, toda vez que es constituida, de fondo, por la pregunta ¿qué se puede conocer? A propósito del tema Bergson se ubica en un punto intermedio entre el idealismo y el realismo, considera que la imagen es aquello que es más que una representación pero menos que la cosa en sí que el realismo pretende mostrar como objeto de conocimiento. La comprensión de la imagen no sólo lleva a escenarios (...) epistemológicos, también posibilita observar que ahí donde hay una perspectiva ocurre un enfoque interesado de cierto tema. De tal forma que la relación objeto-sujeto se ve trastocada por la implementación de la imagen, como disposición afectiva del mundo que rodea al humano. Si sólo se conocen imágenes, la pertinencia de las distintas ramas científicas cambia según estas estudien imágenes interiores o exteriores. Para nada la actividad mental, puede ser el propiciador de las imágenes mentales, únicamente es una imagen más del conjunto de imágenes. En lo subsecuente, habrá un desarrollo del conocimiento de las imágenes, una propuesta teórica que ofrece una posibilidad distinta a la científica, pero que no es contradictoria. This paper examines two policy initiatives that research shows can increase opportunities for physical activity and, in turn, improve health outcomes. These initiatives — shared use and Safe Routes to School — can and should be embraced by schools to improve student and community health. Fear of liability, however, has made many schools reluctant to support these efforts despite their proven benefits. This paper addresses school administrators’ real and perceived liability concerns and identifies four strategies for managing the fear of (...) liability and mitigating any potential liability exposure. Regular musical activity as a complex multimodal lifestyle activity is proposed to be protective against age-related cognitive decline and Alzheimer’s disease. This cross-sectional study investigated the association and interplay between musical instrument playing during life, multi-domain cognitive abilities and brain morphology in older adults from the DZNE-Longitudinal Cognitive Impairment and Dementia Study study. Participants reporting having played a musical instrument across three life periods were compared to controls without a history of musical instrument playing, well-matched for reserve proxies of education, (...) intelligence, socioeconomic status and physical activity. Participants with musical activity outperformed controls in global cognition, working memory, executive functions, language, and visuospatial abilities, with no effects seen for learning and memory. The musically active group had greater gray matter volume in the somatosensory area, but did not differ from controls in higher-order frontal, temporal, or hippocampal volumes. However, the association between gray matter volume in distributed frontal-to-temporal regions and cognitive abilities was enhanced in participants with musical activity compared to controls. We show that playing a musical instrument during life relates to better late-life cognitive abilities and greater brain capacities in OA. Musical activity may serve as a multimodal enrichment strategy that could help preserve cognitive and brain health in late life. Longitudinal and interventional studies are needed to support this notion. (shrink)

Previous research suggests that all-inclusive superordinate categories, such as “citizens of the world” and “humans,” may represent different socio-psychological realities. Yet it remains unclear whether the use of different categories may account for different psychological processes and attitudinal or behavioral outcomes. Two studies extended previous research by comparing how these categories are cognitively represented, and their impact on intergroup helping from host communities toward migrants. In a correlational study, 168 nationals from 25 countries perceived the group of migrants as more (...) prototypical of the superordinate category “citizens of the world” than their national group, whereas no differences in prototypicality occurred for the category “humans.” Identification with “citizens of the world” was positively associated with a disposition to oppose helping migrants and to offer dependency-oriented help. However, identification with “humans” was positively associated with helping in general, and with offering dependency- and autonomy-oriented help; and negatively associated with opposition to helping. The experimental study manipulated the salience of “citizens of the world” vs. “humans” vs. control category, among 224 nationals from 36 countries. Results showed that the salience of “humans” triggered higher entitativity and essentialist perceptions, and dual-identity representations. No differences due to salience were found for representations of relative ingroup prototypicality or helping responses. Overall, these findings suggest that the interchangeable use of different labels is problematic, considering these might activate different representations, and thus, are likely to lead, in some circumstances, to different attitudinal or behavioral outcomes. Many believe that the ethical problems of donation after cardiocirculatory death (DCD) have been "worked out" and that it is unclear why DCD should be resisted. In this paper we will argue that DCD donors may not yet be dead, and therefore that organ donation during DCD may violate the dead donor rule. We first present a description of the process of DCD and the standard ethical rationale for the practice. We then present our concerns with DCD, including the following: (...) irreversibility of absent circulation has not occurred and the many attempts to claim it has have all failed; conflicts of interest at all steps in the DCD process, including the decision to withdraw life support before DCD, are simply unavoidable; potentially harmful premortem interventions to preserve organ utility are not justifiable, even with the help of the principle of double effect; claims that DCD conforms with the intent of the law and current accepted medical standards are misleading and inaccurate; and consensus statements by respected medical groups do not change these arguments due to their low quality including being plagued by conflict of interest. Moreover, some arguments in favor of DCD, while likely true, are "straw-man arguments," such as the great benefit of organ donation. The truth is that honesty and trustworthiness require that we face these problems instead of avoiding them. We believe that DCD is not ethically allowable because it abandons the dead donor rule, has unavoidable conflicts of interests, and implements premortem interventions which can hasten death. These important points have not been, but need to be fully disclosed to the public and incorporated into fully informed consent. These are tall orders, and require open public debate. Until this debate occurs, we call for a moratorium on the practice of DCD. (shrink)

A person is said to be ‘trust responsive’ if she fulfils trust because she believes the truster trusts her. The experiment we report was designed to test for trust responsiveness and its robustness across payoff structures, and to discriminate it from other possible factors making for trustworthiness, including perceived kindness, perceived need and inequality aversion. We elicit the truster’s confidence that the trustee will fulfil, and the trustee’s belief about the truster’s confidence after the trustee receives evidence relevant to this. (...) We find evidence of strong trust responsiveness. We also find that perceptions of kindness and of need increase trust responsiveness, and that they do so only in conjunction with trust responsiveness. (shrink)

This article defends a non-positivist theory of law, that is, a theory that accepts the necessary connection between legal validity and moral correctness by reference to the work of John Finnis. It begins with the dual nature of law as comprising both a real or factual dimension and an ideal dimension. Important examples show that at least some kinds of moral defect can deprive law of validity from the perspective of a participant in the legal system. The nature of (...) the connection between moral defectiveness and legal defectiveness is specified in terms of three possibilities: exclusive non-positivism, in which all cases of moral defect render law invalid; inclusive non-positivism, in which moral defect renders law invalid in some cases; and super-inclusive non-positivism, in which legal validity is not affected by moral defect at all. The paper argues for inclusive non-positivism as exemplified by the Radbruch Formula, according to which extreme injustice is not law, and which strikes the right balance between the ideal and real dimensions of law, against John Finnis’s account, which can be seen as an example of super-inclusive non-positivism, although his most recent work has tended towards the inclusive version. Between Institutional and Moral Discourse: On Alexy's Legal Philosophy. A review of Matthias Klatt, Institutionalized Reason: The Jurisprudence of Robert Alexy.

Alexis Fontaine des Bertins was the first French mathematician to make use of the calculus of several variables in the integration of ordinary differential equations . In this paper I argue that this usage evolved from Fontaine's ‘fluxio-differential method’ of the early 1730s. In this way I extend the thesis enunciated in an earlier paper in this journal.

El presente artículo se propone analizar la contraposición entre ciertos supuestos básicos del liberalismo, aún en sus versiones más igualitarias, y aquello que consideramos es un requisito para el desarrollo de la democracia. Principalmente se cuestionará la suposición de egoísmo que atraviesa la obra de John Rawls, quien cuando procura ajustar su propuesta de justicia distributiva al realismo psicológico, es cuando más se aferra al pesimismo antropológico que caracterizara al liberalismo desde su emergencia. Sostendremos pues, que la suposición de (...) egoísmo que Rawls es incapaz de dejar de lado, es una justificación nada neutral de la propiedad privada y del mercado, a la que el liberalismo ha recurrido aún de espaldas a la complejidad que es propia de las relaciones humanas efectivas, es decir, cuando el argumento liberal se dice más realista, es cuando es más ideológico. Resumen: Este ensayo tiene como propósito fundamentar teóricamente el carácter situado del conocimiento de la vida cotidiana. Como punto de partida, apoyándonos en la noción de “forma de vida” de Ludwig Wittgenstein, postulamos que nuestras decisiones son, fundamentalmente, usos prácticos de sistemas de reglas históricamente construidas y, por consiguiente, irreductibles a procedimientos algorítmicos de evaluación racional costo-beneficio. Posteriormente, para abordar la cuestión sobre las condiciones que hacen posible la incorporación subjetiva de estas reglas y, con ello, nuestro sentido práctico, recuperamos (...) algunos planteamientos de las tesis del “trasfondo” de John Searle y habitus de Pierre Bourdieu. Luego de esta discusión, a partir de la perspectiva de los conocimientos situados de Donna Haraway, proponemos que la conformación de dicho sentido es siempre parcial, esto es, sujeto a prácticas articulatorias encarnadas. Finalmente, tras exponer sucintamente los principales aspectos críticos de las tesis “trasfondo” y habitus, argumentamos que la perspectiva de los conocimientos situados representa una alternativa plausible para fundamentar teórica y metodológicamente una nueva aproximación al conocimiento de la vida cotidiana.: This essay argues for a situated character of knowledge of everyday life. As a starting point, relying on Ludwig Wittgenstein's notion of “form of life”, we propose that our decisions are fundamentally practical uses of historically constructed rules systems and, therefore, those are irreducible to algorithmic procedures of rational cost-benefit evaluation. Later, to address the question of the conditions that make possible the subjective incorporation of these rules and, with it, our practical sense, we recover some approaches from the “background” thesis of John Searle and habitus by Pierre Bourdieu. After this discussion, from Donna Haraway's perspective of situated knowledge, we propose that the conformation of that sense is always partial; that is, related to embodied articulatory practices. Finally, we argue that the perspective of situated knowledge represents a plausible alternative to theoretically and methodologically support an approach to knowledge of everyday life. (shrink)

In this paper, written for a volume on the work of Robert Alexy, I discuss the idea that law makes certain distinctive claims, an idea familiar from the work of both Alexy and Joseph Raz. I begin by refuting some criticisms by Ronald Dworkin of the very idea of law as a claim-maker. I then discuss whether, as Alexy and Raz agree, law's claim is a moral one. Having arrived at an affirmative verdict, I discuss the content of law's moral (...) claim. Is it, as Alexy says, a claim to moral correctness? Or is it, as Raz says, a claim to moral authority? As such, Efron's text amplifies and enriches our understanding of Hardy, Dewey, and their work. I am not using the word "enrich" casually. Through Efron's emotionally charged reading of Tess, Experiencing Tess, becomes an ongoing effort to reclaim what Dewey, in Art as Experience calls oje) "human experience." In that text, Dewey contrasts "human experience" to stagnant and encrusted modes of criticism that fail to "cope with the emer- 7° gence of new modes of life," and this matters because, to use Dewey's own words again, "the very meaning of an important new movement in any art κ-1 is that it expresses something new in human experience, some new form of. interaction of the live creature with his surroundings, and hence the release, of powers previously cramped or inert." Efron 's book is enriching in that sense, in offering readers an "experience," a completely novel way of doing criticism, of reading, and of "feeling" together with a text. I do not think I exaggerate when I say that I do not know of any other work of recent literary criticism that accomplishes this. Before the Revolutionary War, a 26-year-old Italian thinker, Cesare Beccaria, published On Crimes and Punishments, a runaway bestseller that shaped the Declaration of Independence, the U.S. Constitution, and early American laws. Denis Diderot’s ideas about war and peace crystalize many of the contradictions in the world that he identified. On the one hand, war is a natural product of contradictions between natural law and human developments. On the other hand, it can and should always be subject to moral judgment based on a wide-ranging knowledge of history and context. War can be good if it eliminates tyranny, and bad if it limits freedom, equality, and prosperity. Peace can be good if it (...) cultivates the latter, and bad if it freezes inequality. Diderot never allows himself to rest on universal judgments for all times and all places, but insists upon never-ending comparisons and contrasts between the moral world and the natural world. Philosophical materialism provides the basis for his understanding of the world, but morals provide the instruments of judgment. (shrink)

En pleno ocaso de la resistencia maoísta, nos referimos a los primeros años de la década del noventa, Sendero Luminoso consideraba que el control de la ciudad formaba parte de una lucha estratégico-militar para tomar el poder. Esta visión determinista obligaba a encontrar en las zonas marginales como Villa El Salvador la fuerza necesaria para llevar a cabo la revolución de vanguardias. No obstante, en medio de esta búsqueda se erigió una comuna urbana que llegó a cuestionar el papel de (...) la izquierda y transformar la sociedad capitalista desde el Estado. Por lo expuesto, el propósito de este artículo consiste en analizar e interpretar el quiebre de una forma de autogestión gestada en los cinturones marginales de Lima y en pleno proceso de guerra popular. Para ello, estableceremos un puente de diálogo entre el dato bibliográfico y la reconstrucción testimonial de un movimiento de trabajadores que puso en marcha un proyecto de autorregulación social y política.
